1. Acceptance of Terms
By downloading, installing, or using the Sofra application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
2. Description of Service
Sofra is an AI-powered cooking companion application that enables users to:
- Import and organise recipes from web sources
- Track pantry contents and generate shopping lists
- Discover recipes based on available ingredients
- Use AI features including substitutions, modifications, and cooking assistance
3. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement.
4. Account Registration
You must create an account to use the App. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us promptly of any unauthorised account access
- Accept responsibility for all activities occurring under your account
5. Subscription and Payments
Free Tier: The App offers a free tier with limited functionality as described in the app and on our website. We reserve the right to modify free tier limits at any time.
Premium Subscription: Premium features are available via paid subscription through Apple App Store or Google Play Store. By purchasing a subscription, you agree to:
- Pay the applicable subscription fee
- Apple's / Google's applicable terms of service governing in-app purchases
- Automatic renewal unless cancelled before the renewal date
Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time except as required by applicable law.
Refunds: Refund requests are handled by Apple or Google per their respective refund policies. We do not process refunds directly.
Price Changes: We reserve the right to change subscription pricing. We will provide reasonable advance notice of any price increases.
6. User Content
Your Content: You retain ownership of recipes, notes, and other content you create or import into the App ("User Content").
Licence to Us: By using the App, you grant us a limited, non-exclusive, royalty-free licence to store, process, and transmit your User Content solely for the purpose of providing the Service.
Imported Content: You represent that you have the right to import and use recipes you import from external sources. We do not claim ownership over imported content. Recipe content imported from third-party websites remains subject to those websites' terms and copyright.
Prohibited Content: You may not upload, import, or create content that is unlawful, harmful, or violates third-party rights.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or extract source code from the App
- Use automated means to access or scrape the App's API beyond normal use
- Share your account credentials with others
- Circumvent subscription entitlement checks or usage limits
- Use the AI features to generate harmful content
8. AI Features and Limitations
AI Suggestions Are Not Professional Advice: AI-generated substitutions, modifications, and cooking suggestions are for general guidance only. They do not constitute professional culinary, nutritional, or food safety advice.
Food Safety: AI features are not a substitute for safe food handling practices. Always follow established food safety guidelines including proper cooking temperatures, storage practices, and allergen awareness.
Accuracy: AI outputs may occasionally be incorrect or inappropriate. We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content.
User Responsibility: You are solely responsible for evaluating AI suggestions and deciding whether to follow them.
9. Intellectual Property
The App, including its design, code, trademarks, and non-user content, is owned by us and protected by intellectual property laws. You may not use our trademarks without prior written permission.
10. Privacy
Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify, defend, and hold harmless Sofra and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or applicable law.
14. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may terminate your account at any time by contacting us or using the in-app account deletion feature.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
Informal Resolution: Before filing a formal dispute, you agree to first contact us at support@cookwithsofra.com and attempt to resolve the dispute informally for 30 days.
16. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or in-app notification at least 14 days before the changes take effect. Continued use after changes take effect constitutes acceptance.
